Intellectual Property Notice: 

Artist Rights
Rights to artwork remain the sole property of the Artist, Kristina Vanous, including after purchase. This includes but is not limited to display, the purchase of originals, commissions, prints and current and/or future reproductions of any kind, advertising, the Work and work in progress on websites, social media, portfolios, public broadcast channels (example: YouTube) and more. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.

Collector Rights
Collectors receive exclusive, non-transferable usage rights to the Work for personal use. Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.

Collectors must not claim Work as their own and must credit the Artist, using her social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on. Collector must not edit or modify Work in any way without prior permission from the Artist, Kristina Vanous.

Commercial Rights
Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s website or as agreed upon in writing by the Artist. Commercial rights means usage of Work on any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform. Usage of Work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited. iv. Additional charges will be required for commercial usage is not included.

Note: Businesses, agencies, groups and other organizations should contact Kristina Vanous directly at info@kristinavanous.com or through the contact page to discuss commercial and/or trade licensing arrangements in more detail.

Liability
The Artist is not liable for goods once they are in the possession of the customer and/or Collector. It is not the Artist’s duty to refund, exchange, replace or compensate by any means for the damage of products that have been mishandled by customer and/or the Collector. For example: smudging fingerprints on the white border, tearing fine art prints, damaging works, etc.

As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched. Every print is inspected several times before clearing quality control for shipment and only pristine purchased reproductions are packaged for you to enjoy.

Please read the product descriptions thoroughly and carefully. It is not our duty to compensate customers and/or Collectors who do not read the information provided in the product description prior to purchase. All prints come with borders that are included in the final size of the listing.

Confidentiality
The Artist, customer and/or Collector acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, that will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Indemnification
Collector indemnifies Artist against claims, losses, damages and expenses related to Work usage by the Collector, breach by the Collector of the Agreement, or third-party claims. If Collector’s rights are violated or the Work is not delivered as agreed, Artist will work to remedy the situation first.

Shipping Policies:

Processing
At this time, Kristina’s team is small (just her aka “the artist” and her partnering print foundry) and is dedicated to shipping your orders as soon as possible. Pieces take roughly 1-2 weeks to ship, depending on the day the order was placed. You will receive a trackable shipping confirmation once it has been dropped off at the carrier.

Print process is as follows: Kristina places print order with her partnering foundry in Seattle, WA which is open Monday through Friday (inconveniently, the same business hours as Kristina’s full-time sr. design position) and located about an hour away from her studio. The foundry’s lead times are usually 1-3 days but can sometimes take up to a week, depending on how busy they are with other orders. Upon picking up, Kristina adds any custom embellishments (if applicable) and protective spray varnish, which must dry before preparing the shipment. She then hand-packages each piece and adds any applicable documentation for shipment before dropping off at the appropriate carrier.

Originals process is as follows: Kristina takes each painting with her to get their certificate of authenticity notarized. All oil paintings are varnished 6 months to 1 year after completion and are not posted on the site for sale until each work has at least met the six-month threshold. If purchasing an original painting within this 6-12 month time frame, your painting will be varnished upon purchase before shipping. Curing time takes a few days. The painting will then be lovingly prepared and packaged with its documentation before dropping off the shipment at the appropriate carrier.

  • Original canvas paintings under five feet (152.4 cm) at the largest diameter will be shipped, stretched and boxed at no additional charge anywhere within the continental United States, Canada and Mexico.

  • Original canvas paintings over 60 inches (152.4 cm) at the largest diameter will be disassembled and rolled, packaged with the stretchers inside at no additional charge anywhere within the continental United States, Canada and Mexico for easier, more economical shipping. It is highly recommended to have your painting stretched immediately after receiving to preserve the long-lasting integrity of the painting and avoid any cracking.

  • Smaller original canvas paintings under 24 inches (60.96 cm) at the largest diameter will ship stretched worldwide* at no additional charge.

  • Original canvas paintings larger than 24 inches (60.96 cm) at the largest diameter that are shipping outside of the USA, Canada or Mexico, will be disassembled and rolled, packaged with the stretchers inside for easier, more economical shipping. It is highly recommended to have your painting stretched immediately after receiving to preserve the long-lasting integrity of the painting and avoid any cracking.

  • Requests for larger paintings to be shipped via box or crate rather than rolled may be accommodated for an additional fee (varies by size and destination location). Please email info@kristinavanous.com to coordinate shipping arrangements.

*Please note that duties and taxes may still apply (see “Duties and taxes” section below) when shipping beyond the continent of North America.

If you need a change of address, Kristina must be alerted within 24 hours of purchase in order to guarantee a redirect. Please check your shipping information carefully. Kristina is unable to change the address once your order has been shipped. Please email info@kristinavanous.com or through the contact page as soon as possible. 

Kristina Vanous is not responsible for undelivered packages based on incorrect shipping addresses given by the customer. Please ensure that you provide the complete and correct mailing addresses at the checkout. If you desire a refund in this scenario, a restocking fee of 30% will be applied and the cost of shipping will be recovered by the studio.

Duties and taxes
The studio is operated in Enumclaw, WA and is not liable for duty/import fees on products purchased inside of Canada, the United States or Mexico. This includes but is not limited to the commissioning of a custom piece, originals and fine art merchandise. However, duty/import fees may apply if you are purchasing from outside the United States or their bordering countries.

Any applicable taxes and duties are not included in the checkout total. These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges, so that the shipment can continue to its destination. 

It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to us. Provided that the product is in its original condition, we will refund you the cost of your purchase (minus the costs of shipping to your country).

Returns & Exchanges
Kristina values each and every collector and is grateful for their loyalty. If something has gone wrong, or your piece wasn’t as you were expecting - she will do everything she can to make it right.

We do our best to offer color-accurate photography of the artwork, but please be mindful that calibrations often vary between devices. If color calibrations are of concern, we recommend viewing the item from multiple devices (desktop, iPhone, etc.).

Any returns and exchange requests must be made within 30 days of receiving, and returned back in the same pristine condition as it was sent in order to be accepted for a refund or exchange. This is especially important in the case of Limited Editions and originals. Please do not handle a print or giclée with bare hands, as the oils in your fingers can damage these delicate collectables.

To make a return, please email info@kristinavanous.com or use the Contact form with your order number. We will help you process your return and provide a pre-paid shipping label for your purchase. Simply repackage it, attach the label and drop it off at the post office. Once we receive your return, please allow 3-5 business days for processing. If your return is accepted, please allow 3-5 business days for a refund to appear on your original method of payment, or 7 business days for the processing of your exchange of equal or lesser value. If the item you are exchanging for is greater than the original item received, the difference in balance will need to be paid before processing.

Please note that shipping fees on any and all returned or exchanged items are not covered by the studio. Only faulty merchandise or products not covered under consumer guarantees will return with the shipment paid by Kristina Vanous.
